Marek S. Malicki has practiced as a lawyer since 1973. The success of the practice and its reputation are built on his practical legal advice, intuitive and caring client service. Since 1989 Mr. Malicki has served as a deputy Small Claims Court judge in Central West Region in Ontario.
Over the years, clients have sought Mr. Malicki to represent them in a broad range of complex legal matters. He has done so, meeting most challenges and surpassing expectations. However, to better serve his growing clientele – mostly comprised of word of mouth referrals from satisfied clients – he has narrowed the scope of his services to specific Areas of Practice where he applies his expertise acquired through more than three decades of successfully representing a large and varied clientele.
A respected litigator, Mr. Malicki, enjoys an excellent reputation with the courts, other lawyers, and his clients. He has successfully litigated Family Law and Civil Litigation disputes all over Ontario. Progressive, compassionate, and pragmatic, he encourages negotiation to resolve disputes before they go to trial and thus avoid unnecessary costs and reduce hardships to his clients.
Understanding the real and personal impact of separation and divorce on everyone involved, especially the children and the spouses, Mr. Malicki guides his clients with clarity of vision, sound advice and leadership helping them make informed decisions when dealing with contentious divorce, custody, access and child support cases, adoption, marriage contracts, separation agreements, spousal support, division of property, pension and business ownership division issues ensuring that his clients obtain the best possible settlement. Legal opinions regarding foreign divorces and Hague Convention applications complement his work in this practice area.
Mr. Malicki also represents clients in dealing with matrimonial and estate assets in foreign jurisdictions. Careful planning goes into the preparation of Wills and Powers of Attorney providing guidance in order to avoid misunderstandings among beneficiaries and reduce the need for litigation in the administration of real and personal property as well as over personal care decisions.
When it comes to Estate administration Mr. Malicki provides Executors effective and efficient assistance in the preparation of the necessary court documents for authority to carry out their responsibilities be granted to them. If the need for Estate dispute resolution arises Mr. Malicki is able to provide advice and services including the interpretation and challenging of Wills, mental capacity, the rights of the beneficiaries and the duties of the Executors and Trustees and Elder Law.
In the area of Real Estate Mr. Malicki acts for individuals and corporations who require legal services when buying or selling commercial, industrial and residential properties, including homes, condominiums or cottages as well as with commercial and industrial leases, mortgage financing and refinancing.
In the area of Business, Commercial and Corporate Law Mr. Malicki provides his clients sound advice on agreements, leases, contracts, purchase and sale of businesses, commercial leases, incorporations, shareholder agreements, share purchase and sales amalgamations.
The fact that Mr. Malicki is fluent in English, Polish and Spanish facilitates communication and clients’ understanding of the intricacies of the Law and legal processes which he is able to explain in the language his clients are most comfortable in.
